1. Introduction
These Terms of Service ("Terms") govern your use of the HypHosting platform, including our website, control panel, and all related services. HypHosting is operated from the Netherlands. By creating an account or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Service Description
HypHosting provides game server hosting services, including but not limited to:
- Provisioning and management of game servers (Minecraft, Rust, ARK, Terraria, and others)
- Access to our web-based control panel for server management
- Automated backups, file management, and scheduling tools
- Related support and infrastructure services
3. Account Registration
To use our services, you must create an account. By registering, you agree to the following:
- You must be at least 16 years of age. If you are under 18, you confirm that a parent or legal guardian has reviewed and consents to these Terms.
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the security of your account credentials. Do not share your password with others.
- Each person may hold only one account. Creating multiple accounts to circumvent limits or restrictions is not permitted.
- You are responsible for all activity that occurs under your account.
4. Acceptable Use
You may use your server for any lawful purpose related to gaming and community hosting. However, the following activities are strictly prohibited:
- Hosting, distributing, or linking to illegal content under Dutch or EU law
- Launching or facilitating DDoS attacks, network attacks, or port scanning from your server
- Running cryptocurrency miners, blockchain validators, or similar resource-intensive non-gaming workloads
- Distributing malware, viruses, exploits, or any other malicious software
- Hosting content that infringes on the intellectual property rights of others
- Using resources significantly beyond your plan limits in a way that affects other customers
- Reselling or subletting your server resources without prior written permission
Violations may result in immediate suspension or termination of your account without refund.
5. Payment & Billing
All prices are listed in euros (EUR) and include applicable taxes unless stated otherwise.
- Billing periods: You may choose between monthly, quarterly, or yearly billing cycles when ordering.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
- Payment methods: Payments are processed securely through Stripe. We accept major credit/debit cards and other methods available through Stripe.
- Failed payments: If a payment fails, we will attempt to notify you. Your server will be suspended after a 3-day grace period if payment is not resolved.
- Refunds: We do not offer partial refunds once a billing period has started. However, we offer a 48-hour satisfaction guarantee on new orders — if you are not satisfied within 48 hours of your first purchase, contact us for a full refund.
6. Server Resources
Each hosting plan includes dedicated resources such as RAM and storage as described on the order page. CPU and network bandwidth are subject to fair use.
Because our infrastructure is shared among multiple customers, we reserve the right to limit or throttle a server that is consuming excessive resources to the point where it negatively impacts other customers. We will always try to notify you and work toward a solution before taking action.
7. Backups & Data
- We provide automated daily backups as a convenience. Backup retention is limited and varies by plan.
- While we take reasonable measures to protect your data, you are ultimately responsible for maintaining copies of any critical server data, configurations, or world files.
- We do not guarantee against data loss caused by hardware failure, software bugs, security incidents, or any other event. We strongly recommend keeping your own off-site backups.
8. Uptime & SLA
We strive to provide reliable, high-performance hosting. For details on our uptime guarantee and compensation policy, please refer to our Service Level Agreement (SLA) page.
The following are excluded from uptime calculations:
- Scheduled maintenance windows (announced at least 24 hours in advance when possible)
- Force majeure events, including natural disasters, power grid failures, internet backbone outages, and other circumstances beyond our reasonable control
9. Suspension & Termination
We may suspend or terminate your account and services under the following circumstances:
- Violation of these Terms of Service or our Acceptable Use Policy
- Non-payment after the grace period described in Section 5
- Abuse of infrastructure, support systems, or other customers
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — your server will remain accessible until then.
After your subscription ends (whether by cancellation or termination), your server data will be retained for a 7-day grace period. After this period, all data will be permanently deleted.
10. Intellectual Property
The HypHosting name, logo, control panel software, website design, and all related branding are the intellectual property of HypHosting. You may not copy, modify, or redistribute any part of our platform without prior written permission.
You retain full ownership of and responsibility for all content you upload, create, or host on your server, including world files, plugins, mods, and configurations.
11. Limitation of Liability
Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:
- We make no warranties, express or implied, regarding the reliability, availability, or fitness of our services for any particular purpose.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits.
- Our total liability to you for any claim arising from or related to our services is limited to the amount you have paid to HypHosting in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Dutch or EU law, including liability for fraud or wilful misconduct.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The "Last updated" date at the top of this page will always reflect the most recent revision.
For material changes that significantly affect your rights or obligations, we will notify you by email at least 14 days before the changes take effect. Your continued use of our services after the updated Terms take effect constitutes acceptance of those changes.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms or your use of our services shall be submitted to the competent courts in the Netherlands.
